Instead of spending money on advertising like other companies do, 1-800-Pharmacy takes the advertising budget on every product it sells and gives 50% back to you as Ad Rebates, 40% in Ad Rebates to those that referred you, and donates 10% to a health care charity. Ad Rebates incentivize customers to consolidate their existing purchases and refer their friends. Additionally, every single time a prescription is filled at 1-800-Pharmacy, through one of our referred vendor's mail-order pharmacy or one of their many locations across the nation, you are helping a child be vaccinated in a developing country.

Ad Rebates Program Rules

1. MEMBERSHIP
   
   1. Providing Information
      
      In consideration of your use of the Site and earning Ad Rebates, to get an Account with 1-800-Pharmacy (an "Account") you agree to: (a) provide true, accurate, current and complete information about yourself for your Account (the "Account Information") and (b) maintain and promptly update the Account Information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your Account and refuse any and all current and future use of the Site.    2. Duplicate Accounts
      
      You may not create more than one Account. In addition, only one Account is allowed per (1) household, (2) mailing address and (3) billing address.
      
      
   3. Sign-up Bonus
      
      To qualify for the sign-up bonus, you must:
      
      
      • Reside in the U.S. and have a valid U.S. mailing address; and
        
        
      • Complete all required items in the sign-up form located at www.1800pharmacy.com/rx/signup.
        
        
   4. Account Cancellation
      
      You may cancel your Account any time by emailing service@1800pharmacy.com or calling 1-800-PHARMACY (1-800-742-7622). If you cancel your Account, you will forfeit all Ad Rebates in your Account and credit for all individuals in your Tree (as defined herein). In addition, any requested or pending Cash Redemptions (as defined herein) and other Ad Rebate redemptions for you are removed and forfeited. Additionally, we may terminate your Account at any time if you violate these Terms and Conditions or as otherwise set forth herein. Upon such termination, you will forfeit all Ad Rebates in your Account and credit for all individuals in your Tree, and any requested or pending Cash Redemptions and other Ad Rebate redemptions for you are removed and forfeited.
      
      
   5. Username and Password
      
      In connection with your Account, you will create a Username and a Password. You are responsible for keeping your Username and Password confidential and secure, and you are responsible for all actions taken using your Username and Password.
      
      
   6. Age
      
      To create an Account and to be eligible to earn Ad Rebates, you must be at least eighteen (18) years old or the age of majority in your state or province of residence, whichever is greater.
      
      
2. EARNING AD REBATES
   
   1. Ways to Accumulate Ad Rebates
      
      You may accumulate Ad Rebates through (1) your Qualified Purchases (as defined below) from 1-800-Pharmacy through the Site, including our Partner Mall, or by telephone ("Direct Ad Rebates") and (2) Qualified Purchases by members who have been referred either by you or those who you have referred, up to four generations away ("Referral Ad Rebates"). Ad Rebates are void where prohibited by law or taxed.
      
      
   2. Special Offers
      
      In addition to earning Ad Rebates for the purchases listed above, we may from time-to-time offer bonus Ad Rebates or promotional incentives. Such offers may be temporary in nature. We reserve the right to modify or eliminate such offers at any time. The offers are void where prohibited by law.
      
      
   3. Qualified Purchases
      
      "Qualified Purchases" refers to non-prescription purchases. It excludes cancelled, returned, unaccepted, refunded or fraudulent purchases. Qualified Purchases must be shipped to the address corresponding to such member's username.
      
      Other purchases are not Qualified Purchases. This includes, without limitation, products purchased with discounts or promotions, as determined by 1-800-Pharmacy. 1-800-Pharmacy reserves the right to determine in its sole discretion which purchases are eligible for Ad Rebates.
      
      
   4. Direct Ad Rebates
      
      You will earn Direct Ad Rebates on all Qualified Purchases from 1-800-Pharmacy through the Site, including the Partner Mall, or by telephone. You will be credited with fifty percent (50%) of the Ad Rebates levels (as defined below) awarded by 1-800-Pharmacy for each Qualified Purchase you make.
      
      
   5. Crediting Ad Rebates
      
      You are responsible for ensuring that Ad Rebates earned are properly credited. If you believe that Ad Rebates have been earned but not properly credited, you may be required to submit documentation or other proof satisfactory to 1-800-Pharmacy, which may include copies of confirmations and credit card or bank statements. Any claim for uncredited Ad Rebates must be received by 1-800-Pharmacy within 90 days after the Ad Rebates were earned.
      
      
   6. Levels Subject to Change
      
      The current Ad Rebates awarded for Qualified Purchases ("Ad Rebates levels") are available in the "Ad Rebates" section found at www.1800pharmacy.com/rx/help. In accumulating Ad Rebates, you may not rely upon continued Ad Rebates levels. 1-800-Pharmacy, in its sole discretion and without notice to you, reserves the right to change, modify, withdraw, or cancel any Ad Rebates level.
      
      
   7. Ad Rebates Expiration
      
      All Ad Rebates expire THREE YEARS after they are earned. Ad Rebates redeemed will be allocated on a first-in, first-out basis.
      
      
3. REFERRALS
   
   1. Tracking
      
      When you create an Account, you will be granted a 1-800-Pharmacy.com referral URL. You may use the referral URL to refer other users to the Site. 1-800-Pharmacy reserves the right to change your referral URL at any time and for any reason in its sole discretion. You can find your referral URL by logging into your Account. You can also track all users referred to the Site by you ("Direct Referrals") and all users referred by your Direct Referrals for four (4) generations (your "Tree") by logging into your Account. You will not receive Referral Ad Rebates for any user of the Site that is not listed in your Tree; therefore you are encouraged to check it often. You may request a change of who referred you by emailing service@1800pharmacy.com, or calling 1-800-PHARMACY (1-800-742-7622). If a change is granted, the original referrer will still receive 25 percent of the Ad Rebates received by referrers from you and your Tree. Your new referrer will receive the remainder. We reserve the right to deny any change requests and may assign new sponsors in our sole and absolute discretion.
      
      
   2. SPAM and Unsolicited Email
      
      You may not SPAM (send unsolicited email to persons you do not know) in order to refer other users to the Site. We cannot list all acceptable and unacceptable methods of advertising. If you have a specific question as to whether or not a particular advertising method is acceptable, contact us prior to engaging in that action.
      
      
      • You may not send unsolicited email advertising the Site.
        
        
      • You may send solicited email advertising the Site. However, you must adhere to all current legislation, including the CAN-SPAM Act.
        
        
   3. False Advertising
      
      You may not make untrue or exaggerated statements when advertising the Site or engage in any unfair or deceptive trade practice as defined by law. If you provide information about the Site or Ad Rebates on your website, you must ensure the information is updated and accurate.
      
      
   4. Referral Ad Rebates
      
      Each time a qualified individual creates an Account from your referral URL, you will earn $1 in Ad Rebates, which is subject to change at any time in the discretion of 1-800-Pharmacy. In addition, Referral Ad Rebates will be credited to your Account for all Qualified Purchases generated by your Tree in an amount equal to ten percent (10%) of the total Ad Rebates levels awarded by 1-800-Pharmacy for each Qualified Purchase made by users in your Tree.
      
      
4. INACTIVITY
   
   Your Account will be set to inactive for any of the following reasons:
   
   1. Invalid Email Address
      
      If 1-800-Pharmacy receives a bounce-back error message or similar message when sending an email to you, then we reserve the right to set your Account to inactive. A bounce-back message may occur if you have added 1-800-Pharmacy to you "Ignore List" or marked a message from 1-800-Pharmacy as SPAM, or for other reasons. You should add the address service@1800pharmacy.com to your "Allow List" and/or Address Book.
      
      
   2. No Logins
      
      If you have not logged in to your Account for one (1) year or made a purchase from 1-800-Pharmacy, your Account will be set to inactive.
      
      
   3. Reactivation
      
      If your Account becomes inactive, you may reactivate it within two (2) years of the Account being placed on inactive status by logging into your Account or making a purchase from 1-800-Pharmacy.
      
      
   4. Accumulating Referral Ad Rebates
      
      Referral Ad Rebates will not accumulate while your Account is inactive. 1-800-Pharmacy urges you to ensure remain active by logging into your Account at least every 90 days.
      
      
   5. Current and Accurate Contact Information
      
      You are responsible for maintaining accurate and complete Account Information and promptly updating such information if you move or your contact information otherwise changes.
      
      
   6. Delivery Location
      
      You are responsible for selecting a secure and reliable mail delivery address for any Cash Redemptions (as defined below), product deliveries and other communications from 1-800-Pharmacy. We are not responsible for any stolen or lost checks or other merchandise and will not replace checks allegedly cashed improperly by third parties so long as such check was sent to the mailing address as indicated in your Account Information at the time such check was sent.
      
      
5. PERMANENT REMOVAL
   
   If your Account remains inactive as described above and you have not logged into the Site for a period of one (1) year without being reactivated, your Account will be permanently removed and all Ad Rebates will be forfeited. In the event of your death, your Account is automatically and immediately terminated, and all Ad Rebates accrued in such Account are forfeited. If your Account is permanently removed, you may create a new Account, but such new Account will not have the Tree from your prior Account.
   
   
6. REDEEMING AD REBATES
   
   Ad Rebates may be redeemed on (1) Qualified Purchases through 1-800-Pharmacy or the Site, (2) gift cards or (3) cash, in all cases subject to your compliance with these Terms and Conditions. Your Account, including any Ad Rebates or other credits in your Account, is non-transferable and non-assignable, and may not be pooled, lent, sold, or exchanged. We may change rules about requesting cash payments or otherwise redeeming Ad Rebates in your Account at any time and such changed rules will apply to Ad Rebates already accrued as well as to Ad Rebates accrued in the future.
   
   1. Qualified Purchases
      
      You may redeem Ad Rebates for any Qualified Purchase from 1-800-Pharmacy. Each Ad Rebate will be valued at $0.01 for such Qualified Purchases.
      
      
   2. Gift Cards
      
      You may redeem Ad Rebates for gift cards. Gift cards are accessible through your Account. Each Ad Rebate will be valued at $0.01 for such gift card purchases, which is subject to change in the sole discretion of 1-800-Pharmacy. You must redeem a minimum of 25,000 Ad Rebates (the "Minimum Gift Card Amount", presently $250.00) each time you redeem Ad Rebates for a gift card. The Minimum Gift Card Amount is subject to change at any time, in our sole discretion.
      
      
   3. Cash Redemption
      
      You may request a cash payment using the Ad Rebates in your Account (also referred to as a "Cash Redemption") on the following terms.
      
      You must redeem a minimum of 50,000 Ad Rebates (the "Minimum Cash Amount", presently $500.00) for cash each time you request a Cash Redemption. The Minimum Cash Amount is subject to change at any time, in our sole discretion. You have no right to a Cash Redemption unless you have the Minimum Cash Amount in your Account, and we have no liability to you whatsoever. Until your Account reaches the Minimum Cash Amount, your Account has no cash value and this liability is completely contingent upon your earning the Minimum Cash Amount. Presently each Ad Rebate may be redeemed for $0.01, but such redemption amounts are subject to change at any time, in our sole discretion.
      
      You may request a Cash Redemption by logging into your Account once you have the Minimum Cash Amount. THERE IS A NOMINAL CHECK PROCESSING FEE THAT WILL BE DEDUCTED FROM YOUR AD REBATES BALANCE FOR EACH CASH REDEMPTION YOU REQUEST.
      
      Cash Redemptions are processed each [month] for all Cash Redemptions requested since the prior processing. After requesting a Cash Redemption, you can view your scheduled payment processing date by logging into your Account.
      
      Payments are generally processed on the [1st of every month] and generally mailed via USPS by the [5th]; however, this is subject to change in our discretion.
      
      
   4. Tax Matters
      
      You are responsible for any and all tax liability arising from or associated with your redemption of Ad Rebates for cash, gift cards or purchases from 1-800-Pharmacy. We will require you to provide necessary tax information about yourself (including your Social Security Number) prior to redeeming Ad Rebates when the value of your redemptions of Ad Rebates is greater than $300 cumulatively during a calendar year.
      
      
   5. Fraud Prevention
      
      We may request further information from you to ensure that Ad Rebates have been validly earned. We may place any Cash Redemption or other Ad Rebate redemption request on hold, for any reason, until the requested information has been provided. All decisions by 1-800-Pharmacy regarding fraud or suspected fraud are binding and final.
      
      
7. GENERAL TERMS
   
   1. Website and Program Termination
      
      We may discontinue or terminate all or any part of the Site or the Ad Rebates program at any time. In the event we terminate in its entirety the Ad Rebates program, you will have thirty (30) days in which to redeem any Ad Rebates already earned.
      
      
   2. Privacy and Security
      
      You understand and agree that we will handle information as described in the Privacy Policy, as it may be modified from time to time. We cannot and do not guarantee absolute security, and we are not responsible for any illegal acts of third parties including hacking or similar activities.
      
      
   3. Indemnity
      
      You agree to indemnify, defend and hold 1-800-Pharmacy and its affiliates harmless from and against any and all costs, liabilities, losses, and expenses (including, but not limited to, reasonable attorneys' fees) resulting from any claim, suit, action, or proceeding brought by any third party against 1-800-Pharmacy or its affiliates alleging or arising from or related to your use of the Site or any breach of these Terms and Conditions by you. This paragraph survives expiration or termination of your membership or these Terms and Conditions.
      
      
   4. Independent Contractor
      
      You and 1-800-Pharmacy are independent contractors as to one another. You are not 1-800-Pharmacy's agent or employee for any purpose and shall not hold yourself out as 1-800-Pharmacy's agent or employee.
      
      
   5. Limitation on Claims
      
      You agree that in the event you have or may have any alleged claim against 1-800-Pharmacy or its affiliates, you shall pursue such claim only in your individual capacity, and you shall not agree to join or be a part of any class action, consolidated action, or similar action. You also agree that your damages are limited as set forth elsewhere in these Terms and Conditions and that you are not eligible to receive, and shall not seek, attorney fees in relation to any claim you have or may have against 1-800-Pharmacy or its affiliates.
      
      
   6. Miscellaneous
      
      The accumulation and redemption of Ad Rebates and special offers are subject to applicable government regulations and are void where prohibited by law. You may not sell, assign, or otherwise transfer any rights under these Terms and Conditions, including your Account, Ad Rebates or other benefit; if you do so, you will be liable for damages and litigation costs, including actual attorneys' fees incurred in enforcing this rule. 1-800-Pharmacy may assign or transfer its rights and obligations under these Terms and Conditions. Our failure to act with respect to any failure by you or others to comply with these Terms and Conditions does not waive our right to act with respect to subsequent or similar failures.
